FOIA Request For Court Records

This FOIA (Freedom of Information Act) request was filed on October 1, 2012. I recieved an answer from Headquarters, Air Combat Command, Joint Base Langley-Eustis, VA on October 25, 2012. This request was for court records pretaining to the rumored lawsuit related to this crash. Below is the text of my request, and the answer recieved from the Air Force.

The Air Force stats that the AIB and the court records are not available because they have been destroyed. However, I know for a fact that this is not true. The AIB (Accident Investigation Board) report is available from the Air Force Safety Center at Kirtland AFB, and I also have it available here on this site titled "Crash Investigation Report." Therefore it can be assumed that the court records possibly still do exist, and the Air Force is either unwilling or unable to provide them. It is within reason that the Air Force has simply lost track of the location of the records, which has happened before. This response from the Air Force can be viewed as inaccurate at best, and evasive at worst.

I would like to know the details of a court case that involved the crash of F-15B, tail number 75-0085, that occurred on December 6, 1977. Fatalities in this crash were Lt. Col. David Allen Jacobsen and Col. William H. Walter III. I have been informed that testifying in this case was Mr. Richard J. Dobbek, an aerospace engineer employed at the time at Wright-Patterson AFB.

If possible I'd like to have a copy of the transcript of the court case, and the final determination.
